How to Submit a DMCA Notice
If you are a copyright owner, or are authorized to act on behalf of one, and you believe any content on Castle has been posted in violation of your copyright, please provide us with a notice that includes the following information:
Description of the infringing material: Clear identification of the work or material you believe is being infringed.
Infringing content: Include or describe the infringing work or material that you’re reporting to us, be sure to include its URL(s) or any different specific information that will help us locate the content.
Your address details: This is for correspondence as this matter needs correspondence throughout the process please provide them with your full name, address, telephone number, and e-mail.
Good faith statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Accuracy rapport: A false statement in which you agree that the information in your counter-notice is accurate and that you are the copyright owner or an authority of some sort of the copyright owner with the considered capable to defend them.
Signature: Any person (including you or your authorized representative) may sign.
Upon receipt of your completed notice, we will consider it and determine what action is to be taken in the DMCA context.
Filing a Counter-Notice
If you believe that your material was removed or disabled by mistake or misidentification, please notify the Agent in writing and include the following:
A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
Identification of the copyrighted work alleged to have been infringed, or—if multiple copyrighted works at a single online site are covered by a single notification—a representative list of such works;
Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to permit us to locate the material;
Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and (if available) an electronic mail address;
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
A statement that the information in the notification is accurate, and—under penalty of perjury—that you are either the owner of the copyright that has allegedly been infringed or that you are authorized to act on behalf of the copyright owner.
To file a counter-notice, you must provide the following information:
Signature: The signature of the User submitting the counter-notification, either physically or electronically.
Identifying information regarding the removed content: Including where the removed content previously appeared.
Sworn statement: A statement that you believe that the material was removed or disabled as a result of mistake or misidentification.
Your information: Name, address, phone number, and e-mail for contact purposes.
Jurisdiction agreement: A provision stating a willingness to be subject to [Your Jurisdiction] courts and to receive service of legal process in a dispute.
If the notice we receive follows the required process and complies with the legal requirements, we will comply with the order, or as required by law, and remove or restrict access to the material.
Repeat Infringement and Account Termination
Castle has a policy of not allowing multiple copyright infringes. Repeat offenders of copyright infringement may have their accounts terminated. In case of abuse we reserve the right to delete the content and then take action on the individuals or groups that participate in the DMCA abuse.
Changes to the DMCA Notice Policy
Castle reserves the right to update this DMCA policy from time to time in order to further comply with any changes in the law and changes to our service. Changes to this Privacy Policy will be posted on this page and will be effective when posted. Please check this page often to keep up-to-date.
